The BCC regulates distribution, retail, and testing while the CDFA regulates cultivation.
Though the CDFA provides a larger time window between notification and inspection, the BCC has been providing as little as 48 hour notice prior to arrival. While both agencies have been giving advance notice by phone or email, it is not required for them to do so, so cannabis operations should make sure to be up to date on their compliance. Inspections can happen Monday through Friday any time between 8 am and 5 pm.
If you are currently an owner of a cannabis operation we suggest you make your employees aware of 1) the agency that regulates your operation, and 2) the possibility of inspection. This way they are not caught off guard when someone representing the BCC or the CDFA arrives asking to inspect the premise. Failure to allow access for an inspection is a serious violation, with fines ranging from $1,001 to $5,000 per incident. Lastly, we highly suggest that you direct your staff to ask for credentials before allowing them access.
